maintenance annual plan (amp) terms & conditions
Scope of Services
The Maintenance Annual Plan covers routine maintenance and inspections of the customer's garage door and automatic opener system as outlined in the plan details. It does not include repairs or replacements unless explicitly stated.
Service Schedule
The customer agrees to adhere to the agreed-upon service schedule for maintenance visits, as specified in the plan. Any changes to the schedule must be communicated to the company in advance.
Payment Terms
The annual plan is divided into semi-annual options: 6 months for $295 plus tax and 12 months for $499 plus tax. Credit card payments are accepted with a 3% additional fee. Personal and company checks are no longer accepted forms of payment.
Service Limitations
The Maintenance Annual Plan does not cover damages or malfunctions resulting from misuse, neglect, accidents, acts of nature, or unauthorized repairs or modifications performed by the customer or third parties.
Exclusions
Certain components or parts of the garage door system may not be covered under the Maintenance Annual Plan, including but not limited to cosmetic damages, remote controls, keypads, and batteries.
Service Warranty
The company warrants that all maintenance services provided under the Maintenance Annual Plan will be performed in a professional manner and accordance with industry standards. However, no warranty is provided for pre-existing conditions or issues arising from normal wear and tear.
Cancellation and Refunds
Customers may cancel their enrollment in the Maintenance Annual Plan within the following timeframe for refunds: cancellations within 7 days of enrollment will receive a full refund, cancellations within 30 days will receive a 50% refund, and cancellations after 30 days will not be eligible for refunds. The company reserves the right to deny refunds beyond the 30-day mark.
Liability Limitation
In no event shall the company be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use the Maintenance Annual Plan services, including but not limited to loss of profits, loss of data, or property damage.
Indemnification
The customer agrees to indemnify and hold harmless the company, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from the customer's breach of these terms and conditions.
Tampering Clause
Tampering with the garage door, garage door automatic opener, or any of its components after the repair or installation provided by our technician will void the warranty both for parts and labor.
Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of [Jurisdiction]. Any disputes arising from the Maintenance Annual Plan shall be resolved exclusively in the courts of the jurisdiction where the customer resides.
By enrolling in the Maintenance Annual Plan, the customer acknowledges that they have read, understood, and agreed to abide by these terms and conditions.
